The stud fee of $2,500 includes: A $500 nonrefundable Booking fee is due at the time of the signing of the contract. A $2,000 Breeding Fee that includes fresh semen due payable when mare is vet certified in foal at 55 days.
The Mare owner Agrees:
The determination of the mare’s condition for breeding is the Mare Owners responsibility. To have a culture and cytology performed on the mare, verifying the mare is free of infection or disease and in sound breeding condition.
Provide a photo of the mare. This breeding contract fee applies to this mare only for one embryo, any multiple embryo fertilizations from this breeding contract incurs an additional breeding fee for each embryo transferred that survives to the 55 day verification.
To complete and return the breeding contract and attach the verified sound breeding condition statement to the Stallion Owner, Jonhkeer Z, Llc.
It is the Mare Owners responsibility to contact Butch or Lu Thomas, Willow Tree Farm, Inc at (209)765-3134 or luthomas@wt2win.com to order the semen.
The semen must be shipped to a veterinarian/clinic that accepts and uses fresh semen. The mare must be inseminated by a licensed veterinarian. Dr. Jim Bergum, DVM, (209) 748-5500 or Dr. Hilda Bazel, DVM, (209) 333-7400 can be contacted for more information.
Mare owner agrees to pay handling and shipping fees for the semen including any courier fees that may be incurred in the shipping of the semen. Payment of these fees is to be paid directly to Dr. Jim Bergum, DVM, or Dr Hilda Bazel, for arrangements.
After receipt of the semen, the container must be shipped back within seven (7) days using the prepaid Federal Express air bill enclosed in the shipping container. After 7 days a late container fee of $25 per day will be charged.
Mare owner will notify the Stallion Owner no later than 20 days after insemination of mare’s pregnancy status from the results of an ultrasound administered by a licensed veterinarian.
If a live foal (a foal that stands and nurses) is not produced, a one year return policy is included in the Breeding fee. Proof of such loss must be signed by a licensed veterinarian and presented to the Stallion Owner within ten days of the death of the foal. There will be a semen charge for semen ordered for the one year return policy period of time.
If the above named mare dies before being served, another mare may be substituted with the Stallion Owner’s consent. If the semen has been shipped and the client does not wish to substitute another mare, the semen must be returned at the Mare Owners expense and a refund of the breeding fee will be returned minus any costs incurred by the stallion owner or agents. A signed veterinary certificate will be required.
If the above named mare does not ultrasound in foal after two breeding cycles (inseminating the semen by the above recommended protocol #6). mare owner may purchase one additional breeding at 50% original breeding fee.
The Stallion Owner is not responsible for accident, illness, disease or death of mare or the foal.
Stallion Owner:
The Stallion Owner will provide viable fresh semen.
Stallion Owner retains the right to refuse to breed the Mare Owner’s mare at any time. Stallion Owner will first deduct any costs incurred by the mare Owner, and then refund any unused portion. Booking fees are nonrefundable.
The Stallion Owner and mare Owner mutually agree:
This contract is not valid unless completed and signed in full by both the Stallion Agent and the Mare Owner.
This contract is for a period of one year (see #10, 11, 12 for any exception). Any additional agreements must be in writing and signed by both stallion and mare owner.
This agreement is not assignable or transferable by the Mare Owner to any other party.
This agreement shall be interpreted, construed and governed by the laws of the State of California. If it is necessary for either party to tile a lawsuit arising out of this agreement, they will file the lawsuit in Calaveras County in the State of California.
This Agreement constitutes the entire agreement between the parties hereto and supersedes any prior or contemporaneous understanding or verbal agreement with respect to the subject matter herein. It may be amended only by a written instrument executed by both parties.
Live Foal Guarantee is Null and Void
upon the birth of twins
if Mare is bred to another stallion during the term of this Agreement without Willow Tree Farms, Inc written consent
if Mare Owner sells, transfers, assigns or grants a security interest in the breeding evidenced by this Agreement
in the case of embryo transfer, unless Willow Tree Farm, Inc has been informed in advance that this semen will be used for an embryo transplant and Willow Tree Farm, Inc has agreed in writing to this.
If Mare Owner inseminates a mare other than the Mare listed above, with the Semen
